1. Overview

Welcome to BERNITI.

This website and online store are operated by Wherever, Lda., trading as BERNITI (“BERNITI”, “we”, “us” or “our”).

These Terms of Service (“Terms”) govern your use of our website, online store, products and related services (the “Services”). By accessing or using the Services, or placing an order with us, you agree to these Terms together with our Privacy Policy, Return & Refund Policy and any other policies referred to on our website.

Nothing in these Terms limits any rights you may have under applicable consumer protection law.

2. Using our website

You may use our website and Services only for lawful purposes.

You must not use the Services in a way that infringes our rights or the rights of others, interferes with the operation or security of the website, introduces malicious software, attempts to gain unauthorised access to the Services, or uses our content or intellectual property without permission.

If you create an account, you are responsible for keeping your login details secure and for providing accurate and up-to-date information.

3. Products

We make reasonable efforts to describe and display our products accurately.

However, colours and appearance may vary slightly depending on the device and screen used to view them. Minor variations may also occur where they are inherent to the materials, printing or production process.

Product availability may change and we may discontinue products or limit quantities where reasonably necessary.

Nothing in this section affects your statutory rights regarding defective or non-conforming goods.

4. Orders

When you place an order, you are making an offer to purchase the selected products.

After receiving your order, we will send you an order confirmation or other acknowledgement. We reserve the right to refuse or cancel an order where reasonably necessary, for example because a product is unavailable, payment cannot be processed, the information provided is incorrect, or we reasonably suspect fraud or misuse.

If we cancel an order after payment has been made, we will refund the amount paid for the cancelled products.

Please check your order details carefully before submitting your order.

Returns, cancellations and refunds are governed by our Return & Refund Policy and by your rights under applicable law.

5. Prices and payment

Prices are displayed in the currency applicable to the market in which you are shopping.

The total price payable, including applicable taxes and delivery charges, will be shown before you complete your order.

You are responsible for providing accurate billing and payment information and for ensuring that you are authorised to use the selected payment method.

For international orders, customs duties, import taxes or other charges may apply depending on the destination. Where these charges are not included at checkout, they may be payable by the recipient in accordance with local law. Where applicable, we will provide the information required by law before purchase.

EU rules require consumers to receive clear information before buying about the total price, taxes, delivery costs and other applicable charges. 

6. Shipping and delivery

Available delivery methods, costs and estimated delivery times are shown during checkout or elsewhere on our website.

Delivery times are estimates unless we expressly agree otherwise. Delays may occasionally occur due to circumstances outside our reasonable control.

Where BERNITI arranges delivery to a consumer, we remain responsible for the goods during transportation as required by applicable law.

Please ensure that the delivery information provided with your order is complete and accurate.

7. Returns, refunds and your consumer rights

Our rules regarding returns, withdrawals and refunds are set out in our Return & Refund Policy.

If you are a consumer in the European Union, you generally have a statutory right to withdraw from an online purchase within 14 days, subject to the conditions and exceptions provided by applicable law.

You are responsible for the direct cost of returning goods when exercising the right of withdrawal, unless otherwise stated or where applicable law provides otherwise.

Nothing in these Terms or our policies limits your statutory rights concerning defective, damaged or non-conforming goods.

This also reflects the EU requirement that consumers be informed before purchase about withdrawal rights and responsibility for return costs. 

8. Intellectual property

All content made available through the Services, including the BERNITI and Galáxia TOTH names and identities, characters, illustrations, stories, text, graphics, logos, designs, photographs, videos, audio and other creative material, is owned by or licensed to BERNITI and is protected by applicable intellectual property laws.

You may access the content for your personal, non-commercial use.

Unless expressly authorised by us or permitted by law, you may not reproduce, distribute, modify, publish, commercially exploit, create derivative works from, or otherwise use our content or intellectual property without our prior written permission.

All rights not expressly granted are reserved.

9. Third-party services and links

Our Services may contain links to or use services provided by third parties, including payment, delivery, social media or other technology providers.

Third-party services may be subject to their own terms and privacy policies. We are not responsible for third-party websites or services that are outside our control, except where applicable law provides otherwise.

10. Relationship with Shopify

BERNITI is powered by Shopify, which provides the technology that enables us to operate our online store.

However, purchases made through our store are made directly between you and BERNITI. Shopify is not the seller of the products purchased from BERNITI.

Personal information processed through our store may also be processed by Shopify as described in our Privacy Policy and Shopify's applicable privacy policies.

I have deliberately kept this section because the Shopify template itself specifically says its description of the relationship with the store should not be removed or modified. Markdown colado

Our collection and processing of personal information is governed by our Privacy Policy.

Please review that policy for information about the personal data we collect, how we use it and the rights available to you.

12. Liability

We do not exclude or limit liability where doing so would be unlawful.

Nothing in these Terms excludes or limits any mandatory rights or remedies available to consumers under applicable law.

To the extent permitted by law, we are not responsible for losses resulting from circumstances outside our reasonable control or for losses that were not reasonably foreseeable when the contract was entered into.

The original Shopify version went much further in attempting to disclaim warranties and liability. Markdown colado I've deliberately made this much more restrained because standard consumer terms in the EU must be fair, transparent and understandable and unfair terms are not binding on consumers. 

13. Changes to these Terms

We may update these Terms from time to time to reflect changes to our Services, business practices or legal and regulatory requirements.

The current version will be published on this website together with the date of the latest update.

Where required by applicable law, we will provide notice of material changes.

14. Governing law and consumer rights

These Terms are governed by the laws of Portugal.

If you are a consumer, this choice of law does not deprive you of any mandatory consumer protections that apply to you under the laws of your country of residence.

Nothing in these Terms restricts any right you may have to use applicable consumer dispute-resolution mechanisms or to bring proceedings before a competent court.
